What the new state-approved OSHA thermal regulations mean for local businesses and workers

LAS VEGAS (KTNV) — We have been we talk about it all year round. And now, following a record number of heat-related complaints filed this year with the Nevada Occupational Safety and Health Administration, the state department responsible for heat illness the regulations are now in force.

The Nevada Secretary of State filed the regulation earlier this month.

Victoria Carreon, administrator of the Division of Industrial Relations, which oversees OSHA, said the process took about four years.

“We had various ideas on how to regulate,” Carreon said.

“Ultimately what proved effective was that instead of looking for a fixed temperature that would trigger any requirement, we found that this was more efficient and we were able to achieve a well greater stakeholder buy-in by simply requiring each employer to conduct an occupational risk analysis for each job type classification.

Now, public companies with more than 10 employees must conduct an occupational hazard analysis, develop a written plan based on that analysis, designate emergency procedures, and provide heat-related training to workers.

Channel 13 spoke with Santy Luangpraseuth, owner of Bambu Desserts, in June about the problems his business is facing the heat. She is in the process of expanding her business with two additional locations and says this regulation couldn’t have come at a better time.

“They should have implemented it a long time ago,” Luangpraseuth said.

In our June report, Luangpraseuth told us she arrived at work early to turn off the stove before noon to protect the place from overheating.

Carreon said this new regulations are a crucial next step.

“We know empirically that heat stress can cause heat illness,” Carreon said. “You can get heat exhaustion. You can get heat stroke. These are very real medical issues that we need to be aware of.”

According to Nevada OSHA, there have been 401 heat-related complaints this year in Southern Nevada. In 2023it was 300. In 2022it was 210.

Luangpraseuth said she was ready to implement the new measures.

“It’s getting hotter and our summers are getting longer,” Luangpraseuth said. “Every business owner, it is your responsibility to make sure your staff is hydrated and taken care of.”
